Confidentiality: 

To encourage the creation, nurturance, and sustenance, of safety and trust in client-therapist relationship, all interactions during the therapy process including the scheduling, attendance of sessions, therapy notes would not be shared with a third party, be it an individual or organization, including those that may have referred you for therapy to me.

The Law protects the privacy of what is communicated between a client and a therapist. In most situations, I can only release information about the sessions to a third party if you sign a written Authorization that states that you explicitly consent to the breach of confidentiality.

 

However there are exceptional situations wherein confidentiality may not be maintained:

  1. If there is evidence of clear and imminent danger to your well-being, I would like to inform emergency contacts and/or institutions (selected by you). This would be done with your knowledge and consent.
  2. I may occasionally find it helpful to consult other health and mental health professionals about my work with you. During a consultation, I will make every effort to avoid revealing your identifying details, like name, workplace, contact number. The other professionals are also legally bound to keep the information confidential.

 

There are some situations wherein I might be required to disclose information without either your consent or authorization:

  1. If you are involved in a court proceeding and a legal request is made for information concerning my services I may have to disclose information to comply with a court order.
  2. If a government agency is requesting the information, I may be required to provide it to them.
  3. If you file a complaint or lawsuit against me, I may disclose relevant information regarding you in order to defend myself.

 

There are some situations in which I am legally obligated to take actions, which I believe are essential to attempt to protect others from harm. These situations are not common in my practice but constitute the following:

  1. If I have reason to believe that a child has been abused (physically, emotionally, or sexually) by you, the law requires that I contact the local Child Welfare Committee or an equivalent authority to ensure the protection of the child in question. Once such a report is filed, I may be required to provide additional information.
  2. If I have reasonable cause to believe that a disabled adult or elder person has been abused, I am required to report that to the appropriate agency. Once such a report is filed, I may be required to provide additional information.
  3. If I determine that you present a serious danger of violence to another, I may be required to take protective actions. These actions may include notifying the potential victim, and/or contacting the police.

 

If any of the following situations arises, I will make every effort to fully discuss it with you before taking any action and I will limit my disclosure to what is necessary. Please feel free to share any concerns or questions you may have about confidentiality.
